Pubblicato nella G.U. n. 183 del 7 agosto 2017 e in vigore dal 22 agosto scorso il D.P.R. n. 120 del 13 giugno 2017, recante la disciplina semplificata della gestione delle terre e rocce da scavo.
Il decreto costituisce un testo unico in materia e definisce le modalità di gestione nei cantieri di piccole dimensioni (< 6000 m3), grandi dimensioni (< 6000 m3) e grandi dimensioni non sottoposti a VIA o AIA; abroga il D.m. 161/2012 e il comma 2-bis dell’art. 184-bis del D.Lgs. 152/06
Sono chiariti i criteri per qualificare le terre e rocce da scavo come sottoprodotti, ai sensi dell’art. 184-bis del D.Lgs. 152/06, le modalità di deposito temporaneo delle terre e rocce qualificate come rifiuti, le modalità di verifica della non contaminazione per quelle escluse dalla disciplina dei rifiuti e le disposizioni per i siti oggetto di bonifica.
La normativa previgente resta valida per piani e progetti già approvati alla data del 22 agosto 2017.
