Con la nota n. 694 del 24 gennaio 2024 ’Ispettorato Nazionale del Lavoro ha voluto rispondere ad alcune richieste di chiarimento relative all’obbligatorietà della certificazione dei contratti per il personale impiegato in servizi in ambienti sospetti di inquinamento o confinati in regime di appalto o subappalto.
Il D.P.R. n. 177 del 14 settembre 2011, ha introdotto alcune disposizioni finalizzate a qualificare le imprese ed i lavoratori operanti in tali ambienti e ha previsto, quale requisito obbligatorio, la “presenza di personale, in percentuale non inferiore al 30 % della forza lavoro, con esperienza almeno triennale relativa a lavori in ambienti sospetti di inquinamento o confinati, assunta con contratto di lavoro subordinato a tempo indeterminato o anche con altre tipologie contrattuali o di appalto, a condizione, in questa seconda ipotesi, che i relativi contratti siano stati preventivamente certificati”.
