In data 6 febbraio 2024 la Commissione per gli interpelli ha risposto ad un quesito posto dall’Università degli Studi di Milano:
“A fronte delle varie differenti applicazioni nei vari ambiti della P.A. dell’assunto in oggetto, si chiede a Codesto Ministero di fornire un’interpretazione univoca della legge, ovvero di chiarire se un soggetto, anche se non esposto, né segnalato esposto ad alcun rischio lavorativo (chimico, biologico, meccanico e per uso di VDT), debba essere visitato dopo i 60 gg di assenza per malattia”.
Al riguardo, premesso che il D.lgs. 81/08:
La Commissione ritiene che solo i lavoratori soggetti a sorveglianza sanitaria debbano essere sottoposti alla visita medica, al fine di verificare l’idoneità dei medesimi alla mansione.
