Il D. Lgs. n. 81/2008, all’art. 37, prevede l’obbligo, in capo al Datore di Lavoro, di assicurarsi che “ciascun lavoratore riceva una formazione sufficiente ed adeguata in materia di salute e sicurezza”, e al comma 12 si esplicita che “la formazione dei lavoratori e quella dei loro rappresentanti deve avvenire […] durante l’orario di lavoro e non può comportare oneri economici a carico dei lavoratori”.
A tal proposito, in una recente sentenza della Cassazione, n. 20259 del 14 luglio 2023, i Supremi Giudici sono stati chiamati a pronunciarsi proprio su cosa debba intendersi per “durante l’orario di lavoro”.
