Facendo seguito alla precedente nota (vedi news precedente: https://www.scsa.it/ambienti-confinati-chiarimenti-dellinl-certificazione-contratti/) concernente gli obblighi di certificazione nell’ambito dei luoghi confinati e ambienti sospetti di inquinamento di cui al D.P.R. n. 177/2011, l’Ispettorato Nazionale del Lavoro (INL) con la nota n. 1937 del 7 marzo 2024, ritiene che debba essere osservata una interpretazione “letterale” dello stesso D.P.R. n. 177/2011 secondo la quale sono oggetto di certificazione ai sensi del Titolo VII, Capo I – recante “Certificazione dei contratti di lavoro” – del D.Lgs. n. 276/2003, esclusivamente i contratti di lavoro c.d. “atipici” e non anche i contratti di lavoro subordinato a tempo indeterminato.
L’Ispettorato informa inoltre che ha ritenuto opportuno proporre una modifica dello stesso D.P.R. n. 177/2011, la cui attuale formulazione è indubbiamente suscettibile di diverse interpretazioni.
